Legal Question in DUI Law in Minnesota

Consumption of Alcohol by a Minor

Hello, I am a 19 years old attending college in northern minnesota. I just got a minor consumption charge while walking back to campus. I recently got an ''Not a Drop'' violation while driving a month ago. So my question is, what is the penalty for a second minor consumption offense and if it has more harsh penalties because my first charge was while driving?

Re: Consumption of Alcohol by a Minor

I have not researched the matter in response to this question. I do not recall, however, any charge or mandatory minimum sentence enhancement for minor consumption based upon a similar prior. A judge may, though, impose and execute a tougher sentence (compared to a first offense) based upon a prior.

If you pled guilty to an underage drink drive offense, as your question implies, then the bigger question may be whether the new charge violates a no alcohol related offense condition of probation on the underage drink drive conviction.
