It's a free country. They can wait anywhere they want. This is a practice that they engage in all the time. Nothing at all wrong with it.

The question, however, is - did the officer have a valid reason to make the stop and the arrest? They have to have what is called "probable cause" for the stop and arrest. Recently our court of appeals ruled that entering an intersection on a yellow light was not probably cause for a stop. That decision helped me get charges against one of my clients dismissed.
