Legal Question in DUI Law in Minnesota

Court Ordered Treatment

I was told to get court ordered treatment for a DUI in MN. I complied and went for an assesment and was directed to the treatment program. It had been a month after visiting with them when I got a letter in the mail saying my case had been closed and I had to pay a 200$ bill. After calling them back asking why this happend they said I had no funds to support my treatment and the issue will be taken back to court. I have no insurance and no way to pay this 3,000$ treatment program. What will happen to me if I dont pay this money and dont go to treatment? What will the courts etc. do to me?

Re: Court Ordered Treatment

Thank you for your question. As the previous attorney mentioned, I also presume you have either pled guilty or were found guilty of a DWI offense. As such, you are now on probation and dealing with the requirements imposed by the Court.

Bad news first: If you do not follow the requirements set by the Court (that is-treatment) your probation could be revoked and you could be subjected to jail and/or fines in addition to what you have done so far.

Good news: You can apply for what is commonly known as a "Rule 25" assessment. This "Rule 25" is state-funded treatment. The state of Minnesota will help with the costs of your treatment if you are unable to afford the treatment.

It is important that you speak with your probabtion officer and inform him/her that you are having money/insurance problems and are unable to afford treatment.

They should help you with getting a "Rule 25" evaluation.

It is important that you tell probation that you are willing to do treatment-but that you simply cannot afford it.

If I can help answer any other concerns-please feel free to contact at the information below.

Thank you.

Re: Court Ordered Treatment

I presume you were convicted of DWI and, following your conviction, were placed on probation. I am guessing you also had some jail time "hung over your head.

If you were ordered into treatment as part of your probation, and you do not complete treatment, your probation could be revoked and the court could impose jail time. If you don't have the ability to pay for treatment, you need to contact the probation office in the county where you were convicted.

Without knowning more about the particulars of your charge, conviction and terms of sentence, I cannot give you a definitive answer to your question. If you have further questions, my contact information is below.

Good luck.
