Legal Question in DUI Law in Minnesota

Day parole

My brother is currently serving nine months for a probation violation (2nd year of a 7 year probation following 4 DUIs--he failed a breathalayzer when his parole officer showed up to his house randomly). His release date is 11 days AFTER my wedding. Is there any way he could be released for the day, or at the very least, the ceremony?

your brother would have to seek a furlough from the sentencing judge. It is completely discretionary on his part. Contact us if you would like assistance in this matter.

He may file a Motion for a furlough to attend the wedding. There is no guarantee and it is ultimately up to the sentencing Judge. After four DWI's and a probation violation, it would seem unlikely. That is particualrly true since weddings tend to be a place where alcohol may be consumed.

if it is in pa, he can file a motion with the judge for early parole, or for parole just for the day. however, i agree with the previous response that a wedding is a place where there is a lot of alcohol, so you may not want him to be exposed to that. If its in PA and you tell me the judge, i can give you a better opinion.
