Legal Question in DUI Law in Minnesota

DUI expungement in Minneapolis

Hi,

I got DUI in Minneapolis in 2006. It was a 4th degree misdemeanor.

I got unsupervised probation for one year which is over now. I did not have to take any alcohol classes nor i had to do community service. I just had to pay fines which i already did at the time of sentencing. Now everything is over. I want to know if i can get my record cleared now, as till date i have been thinking very deeply and constantly about this case. I am really in a very pathetic state as i cannot apply for jobs nor i can travel to any country with the fear of my DUI case. You might be aware that DUI makes you inadmissible in Canada. All these things have made me to go in a state of depression.

Please give me a genuine opinion in this regard.

Thanks

While it may be good for you, a record is by definition a collection of past events. So if you basis is not something legally recognizable, like the person convicted is not you, but rather you just don't like the truth being held against you, you do not have much recourse.

I am afraid that an expungement on a DWI is not likely. Any DWI is enhanceable if your have a subsequent charge within the next ten years. As a result, the court would not e likely to grant a judicial expungement under those circumstances.

It is extremely unlikely that a person could get a DWI or implied consent violation "expunged" in Minnesota.

You may be able to get "rehabilitated" for travel to Canada, by filling out a form and paying several hundred dollars to Canada's government. Check their website FFI.
