Legal Question in DUI Law in Minnesota

DUI records and expungement

What are the steps or are there any for getting DUI's of Failure to comply off your record. IT has been over five years and I not longer live in that state but it is affecting job oppurtunities and I would like to move past this.

Re: DUI records and expungement

Mr. Beaulier's right. Might as well forget getting a DWI expunged.

Just yesterday I received a call from a gentleman who had received a DWI. Most of the call consisted of him trying to talk himself out of hiring a lawyer, at which he apparently succeeded. I tried to explain that he should be sure it was handled well, because it would be on his record the rest of his life or at least a very long time. He didn't seem to get it.

I would be interested to know. Did you handle this yourself without a lawyer?

Re: DUI records and expungement

The Courts will not generally expunge a DWI record. That is particularly true since a DWI may enhance a subsequent charge for ten years.

Even if you were to get a Judicial expungement, that can only expunge judicial records. Your driving record is a record of the executive branch and an administrative agency. It would still exist.
