DWI Citation given with only .07 breath test

How can a Minneapolis give out a DWI citation to a person that tests out at .07? Isn't .10 still the legal limit? They say that the citation needs to be plea bargained in court to a lessor charge. Is this the norm?

They may still charge you with a DWI if your driving conduct indicates that it was alcohol affected. Such a case is very difficult for the prosecuter. You must be very careful, however, not to accept a plea bargain that is no bargain at all. A careless driving ticket is likely to be offerred. DO NOT ACCEPT this offer. If it alcohol related, it will have the exacvt same effect as a DWI for purposes of fines, penalties, future enhancements and even an increase in insurance rates.
