In Minnesota, it depends upon whether you are facing a third within ten years, have a prior felony DWI or other certain other alcohol-related felonies, refused to provide a sample for chemical testing, have other prior alcohol-related drivers license revocations within ten years, were alleged to have been 0.20 or more, or, had a child under 16 in the vehcile if you are more than 36 months older. The felony DWI maximum sentence is 7 years and $14,000. The Gross Misdemeanor maximum sentence is one year and $3,000, plus other conditions. The simple Misdemeanor maximum sentence is 90 days and $1,000, plus other conditions. With prior similar offenses within ten years there are "mandatory minimum" sentences, which are far more important than the maximum setences. The "implied consent" drivers license revocation, vehicle plate impondment, vehcile forfeiture, and no-alcohol restricted "B-Card" drivers license issues, are usually more important as well.
