Legal Question in DUI Law in Minnesota

Illegal Consumption

Ok, this happened in St. Paul, MN. I got in a argument with some individuals and we were going--name removed--fight. 1 officer came up and 5 security officers came . They split us apart got our information and we told our story. So then the police officer says that he is going--name removed--cite me with illegal consumption of alcohol. I did not have any alcohol on me at all. I was coherent and everything and did what he said. He says that he used his past expericance--name removed--determine that I was consuming alcohol. So I got a citation and I am wondering If there is a possibility I could get the citation dropped.

Re: Illegal Consumption

This sounds like the cop and you have two different versions of what happened, as often is the case. You would be well advised to retain a criminal defense lawyer to help you investigate the case, get favorable witnesses lined up, research the law, and prepare well for trial. If this is done, the prosecutor may offer a favorable resolution before trial, especially if you have a clean record. It is difficult to say more without being the lawyer working on the case.

It ould be a very difficult case for a prosecutor to prove. It is quite likely that the matter will be stayed for prosecution meaning it ultimately results in no ticket. For a FREE consultation call us at 952.831.5000 or visit us online at criminal-law.tv
