immigrant
One of my friend just recently got a DWI. He is not a citizen. He got a Work Visa to come to America to work only. Is he going to be deported due to this DWI. Is there a way to help him out. He's a good person. Has no crime record at all. Please respond ASAP.
THANK YOU.

Re: immigrant
I have never seen or heard of a case where there was a deportation. My understanding is that DWI is not considered to be a crime of "moral turpitude."
If your friend had robbed or assualted someone, the result might be different.
It would be a good idea for this person to become a citizen as soon as possible, sot that he or she does not have to worry about these questions.
Re: immigrant
While I do not practice in the immigration law area per se, I do regularly represent non-citizens charged with crimes. The consequences to non-citizens of a criminal charge can be incredibly severe, compared the consequences a citizen may face -- due to federal immigration law. In order to determine the risks your friend faces, I would recommend consulting with an immigration lawyer, and if I were representing him, I would also seek detailed information about his situation to I could make my own independent legal research effort on his behalf.
In the meantime, based upon my past experience, I believe it unlikely that your friend would suffer significant, if any, immigration law consequences if he (1) challenged the "implied consent" driver's license revocation within 30 days, and won it; and (2) avoided a conviction in the DWI criminal case.
DWI law, as you may know, has become incredibly complex over the years. His best course of action would be to retain a good DWI defense lawyer experienced in protecting the interests of non-citizens, such as myself. He is welcome to give me a call or contact me.
