Legal Question in DUI Law in Minnesota

Minor Consumption camping trip

9 friends and I were camping at a park in Itasca, and we are all 18. It was one in the morning when a sheriff was patrolling and walked up on us. There was no beer out but he looked in our coolers and found our beer. No one blew above a .085 ranging down to .015. Is there anything to do since it is most of our first offenses to get the fine reduced or if were lucky, erased. The sheriff did write on our tickets that we were cooperative and well behaved

There can be no search without a warrant unless you consent or unless the officer had probable cause to believe a violation was committed. You may challenge the search and seek to suppress the evidence.

Your story sounds as if there was a possible illegal search. The trouble is that by the time the officer writes his report, the story may be different. When it's your word against the cop, it's not a good situation.

You should not face this without legal representation. There may be quite a bit a lawyer could help you with here, particularly for those with the lower readings.

This is for general information only and does not create an attorney-client relationship. You are advised to seek the advice of the lawyer of your choice.
