Legal Question in DUI Law in Minnesota

my nephew received a ticket for under age consumption he was a passenger in the vehicle the driver his girlfriend and she had not been drinking he blew a .17 He is 19 this was in Crow Wing county in Minnesota. What fines etc. would he be likely to get? first offense Thank You

If your nephew is being charged under Minnesota Statute 340A.503 (drinking underage) - he will likely face a Misdemeanor with a statutory minimum fine of $100 (Minn. Stat. 340A.703) and a maximum of $1000 and 90 days in jail. There may be issues with the ticket though. One of my first questions is what grounds the officer had to stop and ask your nephew to take the test.
