Passenger of the vehicle

If the owner of the car is in the car with a sober driver. The driver can still get a DWI. Is this true. MN

I am not sure that I understand the question.

If the owner of a car is intoxicated and is a passenger in the vehicle with a sober driver, they cannot be gieven a DWI since they were not operating the motor vehicle.
