After being released from prison for a felony DWI i was placed on 5 year conditional release. Is this double jepardy and can i get it waived?

It is not double jeopardy and it is part of the sentence imnposed which would include incarceration in addition to supervised release.
You can always file a Motion to modify the sentence, but you would need compelling facts to acquire such an order.
