Legal Question in DUI Law in Minnesota

Revocation of license

Is there any recourse if my drivers license has been revoked simply because someone called and said they saw me drinking and i smelled of alcohol. I received a B-card 13 years ago and three years ago went in and had the b- card notation and extra card I needed to carry removed at the driver and vehicle services office. Do I have a chance of fighting this? The person who called is mad at me and is trying to cause me as much trouble as possible. I have had no other alcohol related incidents in the last thirteen years.

Re: Revocation of license

If you read the notice which revoked your license, you should see a section which lays out your options. Usually you have a right to an administrative review and to a judicial review. There are time limits for each, so you best get moving quickly.

As far as the judicial review goes, it would be very difficult to do it yourself without a lawyer. Get to someone competent in this area of the law and consult with him or her.

Good luck.
