Legal Question in DUI Law in Minnesota

Out of State DUI Laws

I was recently arrested for my second DUI in 5 years in Fargo, ND. However, I am a Minnesota resident and was wondering if I will be responsible for paying fines in both states. I know my driving privileges will be revoked in both, but are there any other penalties that carry over from state to state?

Re: Out of State DUI Laws

The so-called "criminal" penalties can only be imposed in the state where the crime occurred, not any other. But the drivers license penalties may be imposed in both states, in the form of a "reinstatement fee," and perhaps other fees and conditions for reinstatement of right to drive. Call the drivers license agency in each state for details of their requirements.

Of course the way to avoid all of it is to retain a good DWI defense lawyer and win the "criminal" and the drivers license revocation case in the state where the arrest happened.
