Re: beneficiaries
I need more information:
Beneficiaries generally have rights only after a person has died. Does the Durable Power of Attorney require that you give an accounting to anyone? What are the realtionships between you, the person who is incompetent and the people asking for the bank statements?
Generally, a person holding a durable power of attorney must give an accounting (including copies of bank statements) only (1) to the person who gave him the power or attorney, (2) to that person's guardian (if any), (3) to anyone specified in the power of attorney, and (4) to a court if so ordered (some relatives and the county are entitled to ask a court to order an accounting if they believe the holder of the power of attorney is not performing properly).
Please e-mail me further information and any other questions.
