Legal Question in Family Law in Minnesota

7 county metro area

My ex and I have shared custody, but will be going reviewing custody this summer. I will be asking for full physical and legal. Due to the fact that in the last year our son has lived with me and his father has seen him only a few times. With the way our papers are now neither one of us can move outside the 7 county metro area. If I were to get custody would I be able to have that changed so that I'm free to move anywhere with in Minnesota?

I would have to see the divorce papers first, but my guess is that you would have to demonstrate to a court that a move outside of the seven county metro area is in the best interests of your son. Please contact me if you have any other questions.

Much would depend on the language in your divorce decree. Nonetheless, if you were to be awarded primary physical custody, you would be able to relocate within the state with the child so long as no preclusion to the relocation appeared in the court order. If any such reloact8ion were planned, you would be required to negotiate a suitable parenting schedule and, often, courts require the relocating parent to bear the greater responsibility for travel expenses related to parenting time.
