Legal Question in Family Law in Minnesota

I have 50/50 legal custody with my ex girlfriend of our 2 daughters. She has full phycial custody. I want to take them to Disney World in Florida for a week in June, but she will only grant me that extra week of parenting time as long as its in MN. Can she make stipulations and dictate where Im able to take them? I sent her an email, to cover my behind, verifying extra parenting time for that week in June and she responded with "As long as I have all the information regarding where you will be camping, in mn, yes you can have extra parenting time." Are there any legal consequences if I just take them to Florida instead?

First. if there are disputes regarding parenting time, your court order would control. If that does not include a week of parenting time in June, there is nothing that requires the visitation to occur.

Second, if you are allowed court ordered parenting tine for a week in June, and there are no restrictions in your order related to travel, the you may take the children out of State.

Based on your inquiry, I would advised you to mediate the issue and if you are unable to resolve it, file a Motion well in advance to seek a court order allowing that parenting time.
