Legal Question in Family Law in Minnesota
I have a 17 year old that has lived with me foor four continuous years. Her father and I have joint legal joint physical custody. He has never paid any type of support in the past four years and has the oppotunity to have time withher whenever he wishes but he chooses not to. My son is the arm and is getting deplaoyment once again. His wife and their newborn twin daughters will be returning to her home state of Ft Bragg, NC. I am wanting to move there and my daughter is also to be close to them and help. My daughter suggested it to begin with. She asked her father who replied that he could have me arrested if I did this. My daughter was asking permission from him so that we wouldn't have to go to court at this age and change custody. She will be 18 next July. What should we do? He is remarried and also remains very enmeshed in what I am doing . I would love to leave. My daughter even researched school, crime, housing and employment and included this in her request to leave. First, you cannot relocate out of state without an agreement from the other parent or a court order. As a result, you run the risk of a court changing custody or imposing other sanctions should your relocate without following proper procedures.
Second, at your daughter's age, her input would be compelling at any hearing. As a result, it is likely that the relocation would be allowed.
