Legal Question in Family Law in Minnesota

My 13 yr old grandson is living with me and has for 4 months. His father is making statements that he has joint custody with his mother (my daughter) and has the right to come and take him from me. My grandson wants to live with me. What are my legal rights?

Unfortunately, you do not have any rights until they are established by the court. Your daughter can let you watch the child during her parenting time. The current order is controlling. So if the order provides when the child should be with the father, you need to respect that aspect. Children do not get to chose where they want to live. It may be a factor in determining what is in the child's best interest, but it is not controlling or even carries more weight than any other factor. As a grandparent, you are going to have an uphill battle to have your grandson live with you if the father is opposed to it.
