adoption

What are the laws for my husband to adopt my12 year old son so he may share my husbands last name. The biological parent is not in our lives, and I wouldn't even know how to find him if I could.

If the biological parent is adjudicated as the child's father, you must file a Petition to terminate parental rights and seek a step parent azdoption. It is a two step process, but it would require serving the biological parent with the Petition.

If the biological parent agrees, it may be done simply by agreement of the parties.

Step-parent adoptions are relatively straight forward if you can get the bilological parent to consent. If you do not know where his biological father is currently located, it will be a little more difficult, but could still be accomplished.
