Legal Question in Family Law in Minnesota
Advantages and legally changing child support payments from County to self
I am pondering having my child support no longer being handled through the State/County. I am not on public assistance, so that is not an issue. But what I need to know is what would happen then? Would I still be able to have hearings to modify child support payments? If he missed payments what would be my recourse? And who do I need to talk to to find out? What type of Lawyer etc?

You may elect to waive automatic income withholding. The major ramification to doing this is that the burden of keeping careful reciords regarding what has vbeen paid will fall on your shoulders. I would suggest keeping Xeroxed copies of any checks received as well as a journal documenting each payment. A better way would be to reach an agreement that child support will be paid by electronic transfer from the obligor's account to yours. That way the payment will be regular and a record is made of each transfer.
You may always seek a modification of support if there is a substantial change in circumstance.
