Legal Question in Family Law in Minnesota
Does an affair matter when filling for divorce? How can I best keep my son if it does?

Yes, an affair may 'matter' in divorce proceedings. As to your personal worries and concerns, I urge you to pay a well-experienced attorney at this time to provide you with detailed legal advice and counsel. Sometimes this is known as 'pre-divorce legal counsel'. We attorneys here do not solicit clients. You may simply make a few phone calls - I suggest you review a few attorneys' online bios', and choose someone with many years of professional experience. Be wary of 'free advice'. Best to you in your new life !!

I disagree with s. Dwyer.
Infidelity only matters in slim circumstances such as instances where it has an adverse impact on parenting. Other than that, it is irrelevant. to all issues. In short, it rarely affects issues of custody and parenting time where courts make decisions based on what is in the chld's best interests.
