If I don't sign an affidavit, can I be subpoened?

You can always be subpoenaed to appear in a court proceeding and prvide testimony. You can also be subpoenaed, in some instances, to appear at a deposition to provide discoverable information. Whether or not the subpoena is valid would depend on how it is served and the nature of the case.
