Legal Question in Family Law in Minnesota

alimony reversal on divorce decree of 30 years ago

my husband was married for 11 years the divorce decree said he had to pay alimony until she remarries or dies. we have paid alimony for 30 years now and she harrasses us every month for the payment. we are suffering financial hardship at the moment and would like to stop the payments to her. furthermore when he divorced her he gave her everything he owned, including the house. she always has said she doesn't have any money and needs our money. this simply is not true because she inherited money when her parents died. she is a high spender and never really worked. she is just milking the cow and or taking her vengeance on us. the divorce decree was in Minnesota and we live in California. we also know she had a boyfriend living with her for many years (we don't know if he is still there), but we know she would never marry him to keep getting our money. What could we do to get out of this nightmare that doesn't cost us a lot of money. Thank you in advance for any suggestions.

In a general sense, termination of spousal support on a long term marriage (10+ years) is always tricky. That having been said, paying alimony for 30 years on an 11 year marriage may be excessive! There are many variables here that need to be explored.

For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!

"Permanent" spousal support is never truly permanent. It may be modified if there has been a change of circumstance that makes the current amount unreasonable or unfair.

That means if your spouse had a reduction of income or an increase in expenses and/or the recipient spouse had an increase in income or decreased expensees, it may be modified.

You could consider filing a motion for termination of maintenance. If

your income has substantially decreased (due to retirement?) or her's has increased, it might be worth a shot.

Any motions need to be filed in the county of the divorce. Before I give any more advice, I would like to know the county we are talking about.

The best idea is to get advice from an attorney who practices in or near the county in question.
