Legal Question in Family Law in Minnesota

My boyfriend had his child support re-evaluated and it was to his advantage because the mother voluntary quit working and his support was suppose to be a high 300 dollars. The child support office screwed up and entered in that he had two joint children instead of 1 when they finalized the order. His support was set at $566 for two children when he only has 1 and his lawyer has filed the correct papers to fix the clercial mistake, but his lawyer says he will have to pay that amount until it is fixed and they can jerk his unemployment. How can he legally have to pay support for 2 children when he only has 1...and suffer when it was the county's mistake? Does he have to pay the unfair amount until it is fixed?

Unfortunately, the court order is controlling and your boyfriend should pay the amount cited in the order until it is resolved. I am not quite sure what you mean by "jerk his unemployment." Hopefully this will be addressed quickly. I doubt that it would be worth going after the over payments, since the time and effort may not be worth it and it doesn't look good to, more or less, sue your own kids.
