change of custody

my 16 year old daughter wants to live with me in a different state. her mother is ok with this, but does not want to sign any custody paperwork, saying her consent is enough. do I need paperwork through the court, or is a verbal arrangement acceptable? is this going to come back to haunt me in the future?

Any agreements must be memorialized as a Stipulation and Court Order in order to be enforceable. By proceeding without a stipulation and order, you run the risk that the your ex may change her mind at any time.

With that said, however, if you have custody of your daughter for an agreed upon period of time, it may form a basis for you to file a Motion seeking a change of custody since the child has been incorporated into your household with the other parent's consent.
