Change to joint physical custody
My husband's daughter has lived with us half time for over seven months. Her mother has full physical custody and still gets full child support. What needs to be done to change to joint physical custody - do we have any rights? Would this be difficult?

You can prepare an agreement for the mother to sign to modify custody or you can take her back to court to request that a judge modify custody. Please call me if you have any other questions. 9527464111

Thank you for your question regarding joint physical custody of your husband's daughter. If possible, the easiest and least expensive way to change the custody arrangement to joint would be to contact the mother and see if she will agree to the change. Otherwise, your husband will have to make a motion to modify custody. Whether this will be difficult depends on the facts of the case and how the mother will react.
However, it does help that his daughter has lived with you for over seven months.
