Re: child custody

Thank you for your question, which I see will involve far more facts than you can reasonably present in this forum.

There are many facts that would affect your rights and the best course of action to take. At minimum, I would need to know why the children are in "DHS" custody (which I presume means they are presently in foster care). How are you related to the children? How long did you care for the children and why did that come to an end? Where did you care for them? In Minnesota, Oklahoma or elsewhere? Do you have a good or bad relationship with the biological parents? What sort of connections do you, the children and the parents have to Minnesota and Oklahoma?

As a very general matter, if the children are under the jurisdiction of a Minnesota juvenile court, it is unlikely they will allow you or anyone else to take the to Oklahoma in the near future, since the immediate purpose of any such proceeding (which I assume is a CHIPS case) is to reunite the children with their parents. If that is not possible, the court may consider you, but that may present some difficulty because you are outside the jurisdiction.

I would be happy to speak with you about this in more detail, since this issue is rather complex. My contact information is below.

Thank you again for your question, and best wishes.
