Legal Question in Family Law in Minnesota
child custody
I Let my child go visit his father in NC for a couple of weeks after I came out of an abusive relationship just to be cordial with him and make sure my son is around his father and his father is around his son..when it came time to bring him back after we continously talk everyday about him coming back home to me he told me he wasn't bringing him back and that I needed to come and get him well after that long story short I rented a car to go get him and he told me I wasn't getting him back and stopped answering my calls and no one around was answering...I consulted mecklenburg co police about this and they told me it wasn't nothing I could do because I dont have legal documentation saying that I have custody of my child but he dosent either...isnt this kidnapping? what do I need to do to get my baby back? he has never paid child support and I never went after him for it I'm also not on any aid...so could this also be sometype of motive for him?

Re: child custody
If he is recognized as the father, and you know where the child is, it is not kidnapping. he has as much right to care for the child as you until a court decides the issue of custody.
If the child has been living in Minnesota, you must immediately commence a custody action to resolve the matter.
