Legal Question in Family Law in Minnesota
Child support REALLY?
My boyfriend recently found out his license is suspended due to back child support, for a kid that was never deemed his. The child was born when my boyfriend was 15, When Aaron turned 18 the courts ''tried to serve him'' for a DNA test, however they were unsuccessful, and he was deemed the father by ''default''. He is now over 20 grand behind, and has never received anything until now. He doesnt believe the child is his, and since it was never proven, and he never signed anything is there anything he can do? He is now 28, and this happened when he was 15...please help us!

Re: Child support REALLY?
One of the elements for the establishment of paternity is that the father be served with process. If the Court entered a default order without establishing that service occurred, it may be possible to vacate the judgment. If your boyfriend has not appeared in the paternity or child support case and only recently became aware of the back child support, he may be able to obtain some relief. Otherwise, he may need to contact the child support enforcement authorities to attempt to negotiate a settlement of his debt.
