Legal Question in Family Law in Minnesota

Child support emancipation definition

I am court ordered to pay child support for my son who is now 17. The court order notes that I must pay until child is emancipated. My son hasn't been living with his mother for approximately six months and has an apartment with an 18 year old friend, he has quit school and his girlfriend is pregnant. Do any of these circumstances fulfill the 'emancipation' definition?

Re: Child support emancipation definition

Sounds like it probably does to me. I would be curious to know, however, whether his mother is paying some of his rent or otherwise supporting him (your son) in his current living situation.

Re: Child support emancipation definition

That may indeed qualoify as emancipation since the mother is no longer providing financial support and the child is no longer pursuing secondary education.

You must bring a motion before the court seeking to terminate child support based on these facts.
