Legal Question in Family Law in Minnesota

Child Support Joint Physical Custody

My x (never married)and I had a joint physical custody arrangement 51% of the time our child was with her, and 49% of the time the child was with me. I was court ordered to pay all support. She is currently in an alcohol rehab for her 2nd time staying at a halfway house, and I have taken sole 100% custody of him. On paper it works out to be 80% me and 20% her, but the child support from the original order is still coming out of my paycheck even though in court documents I have 80% joint physical custody now. Is there a motion I have to file? And how can I reverse this to get child support from her? Thanks

You must immediately file a motion to modify child support and/or the parenting plan or custody.

Yes. You must file a Motion to change the custody arrangement or, at a minimum, change the child support based on the new parenting schedule. If you have any other questions, feel free to contact me. We offer a free initial consultation.
