Legal Question in Family Law in Minnesota

child support or rights of inheritance

im a 30 year old male whos father basically raped my mother. he was tested and admitted to being my father. im just wondering if i ever had a right to child support over the years, because he left town after i was born. i believe he has some money and businesses in the city he lives in. also wondering if i have a stake at his assets and businesses if they still exist after he passes away.

very curious

Re: child support or rights of inheritance

My understanding is that child support is essentially a claim that your mother has or had against your father. In a paternity case, last time I checked, they could go back 2 years from the date the motion for child support was filed. Therefore, to the best of my knowledge, if it's been over two years since you graduated from high school, your mom and you are out of luck in the child support department.

You may have inheritance rights, unless this man specifically excludes you from his will. He has to legally be your father, however - and my guess is from what you include in your story that he is not. He has to either sign a parentage declaration and have your birth certificate amended to reflect him as your father, or be the subject of a paternity order which finds him to be the father.

Interesting question. Good luck.
