Child Support

My wife has joint legal and physical custody of her two children from a previous marriage, with no child support to be paid by either parent. She did have a stipulation entered in the decree that if physical custody fell below a 50-50 split the child support would be paid along with back child support. My wife's ex has had the kids approx only 1/3 of the time in the past 7 months. How can she get her stipulation enforced?

The easiest thing to do would be to have your wife go to the Support and Collections office in the county where she lives and apply for their services. Last time I checked their fee was $25.00. They are a bit slow. It might take them months to act. Once they do, however, they would schedule a hearing on the child support issue before a child support magistrate, and the county attorney's office would be involved on your wife's side (they claim they don't really take sides, but if that's true I'm not Irish).

Frankly, I feel sorry for your wife's X just thinking about what they might do to him. He's in for a rude awakening, unless he's one of those guys out there on the fringe working for cash.
