claiming a minor on your taxes

Can I still claim my child on my taxes even if he doesn't live with me? I only have joint legal custody and parenting time.

Re: claiming a minor on your taxes

You may claim a dependency exemption for the child on your tax return if (1) the other parent agrees to do so, or (2) you have been awarded the tax exemption by the Court.

This advice applies only to the dependency expemtion, however, and not to tax credits. You will want to discuss the issue of tax credits with your tax preparer.
