Legal Question in Family Law in Minnesota

My ex claims my daughter as a tax exemption. She wants this reversed back to me, because I am unemployed & disabled. She would them qualify for financial aid. With her father claiming her on his taxes, she won't get any financial aid help as he & his wife make too much money. How does she accomplish this?

First, I suggest that your daughter talk to a tax preparer who is familiar with tax law. Second, it is not up to your daughter to determine who claims her as a tax exemption. Although I am not a tax attorney, it is my understanding as a family law attorney that at the time of a divorce, this is something that can be negotiated. If it is not a term of the divorce, then usually the parent who has the child residing with him/her claims the child as a tax exemption. Check with a tax preparer for a more detailed explanation.
