Legal Question in Family Law in Minnesota
Contempt of Court
My child's mom filed a contempt of court..wrongly saying I hadn't payed my child support. Comes out of my check, but it's to high so not all gets paid even though I tried to get it lowered they based it off my last job. we have court soon and I need to know what information to bring. We will also look at visitation issues since she hasn't let me see my child for 9 months now. court gave me visitation rights, under Appendix A can I file contempt of court on her? I also found out she has several open cases from social services, I requested (written) information but they haven't given it to me and it's past the 10 day limit.

Re: Contempt of Court
You can file a Motion seeking a Finding of Contempt for a denial of parental rights. Such mostions are not simple and would require acquiring and serving an Order to Show Cause. Additionally, in most cases child suport matters are heard by a Magistrate where you cannot bring a Motion on parenting time issues.

You need to talk to an attorney in person. I suggest that you find one in your community. I practice law in Mankato, and if Mankato is nearby, I encourage you to make an appointment to see me.
