A child can never decide. In order to change custody under Minnesota law, generally, you must allegs sufficient facts for the court to believe the child is endangered in his/her environment and that the benefit of the change outweisghs any harm. Only when you have met that burden can the court consider the desires of a child who is of suitable age and maturity. Even then, the child nver has the final word and what is in the child's best interests is decided based on a totality of the circumstances.
