RE: Custody

My ex-husband is behind on his court ordered child support/spousal alimony. He owes over $35,000 and has been denied modification of the original order. He now wants custody of the children, ages 15 & 11. Is there a good chance he could get it?

It is simply not possible to make an assessment regarding a motion to change custody without a full review of the facts surrounding the case. I can tell you that Minnesota has one of the highest standards for custody modifications in the country which makes seeking a change of custody very difficult.

As a general rule, the person seeking the change must allege that there has been some change of circumstance since the last order and thatt the current custodial situation endangers the children physically, emotionally or developmentally . They must also demonstrate that the benefits of the change outweigh the harm caused by the change.
