Legal Question in Family Law in Minnesota
custody
My husband wants joint physical custody so he doesnt have to pay child support. He spent his whole summer partying getting high and rarely seeing our daughter. I work overnights, so he picks her up every other night ar 7pm. he has a new girlfriend who moved in with him and is paying for his lawyer to fight me for custody He has a bad temper aand he never wanted my other boys around (they are older in their 20s) I am on legal aid waiting for 1 1/2yrs to get divorced, lawyers have been stringing me along saying theyll take my case and then not doing anything, I got a different lawyer on legal aid but how much is she going to fight for me? Am I screwed? I have no money.

Re: custody
Unfortunately, there is an old adage that you get what you pay for, and with the current budget crunch for Legal Aid, consider yourself luck that you get a free lawyer. There is no right to a free divorce lawyer.
As for Joint Physical custody, it is a common tactic for spouses to go for Joint Physical custody for the sole purpose of lowering child support. As a general rule each party must have the kids 50% of the time in order to qualify for Joint Physical custody.
Hopefully you can talk to your free attorney and she will help you, but remember her caseload, she is probably swamped so my advice to you is 1) help her in anyway possible, 2) be sure to stay in touch, 3) dont pester her, and 4) be very clear in your concerns and dont be afraid to tell her what they are. Good luck
