custody and moving out of state
I have sole physical custody of my 2 children. My ex-husband has not seen the kids since Jan. 14th, 2008 with scheduled visitation 3 times a week. He is not answering his phone or returning any messages. Our son turned 5 on Jan 27th and he did not call or even send a card. I was informed by my landlord that I have 60 days to move out (April 31, 08)as her properties are being foreclosed on. My 1 year lease does not end until September 17th, 2008 I have no family support in MN and would like to relocate to GA where I have emotional support and the cost of living is more affordable now that I am a single mother. My question is do I need to do anything legally to make sure that I will not get in any trouble with the law? If so, what steps do I need to take to start this process.

You must have consent of the other parent or, you must file a Motion and seek permission to relocate out of state with the children. If you fail to file a Motion and simply relocate, you risk that the other parent will file a Motion to return the children to their home state and to change custody.
