Legal Question in Family Law in Minnesota

decree issue

In my decree there is a section about a Sports Fund Account to be funded by my ex and myself. We have split custody. We were to establish this to pay for our sons sports activities. At that time it was 2/3 me 13/her. As a result of mediation we chose not to maintain the account and she agreed to pay half of the expenses because I agreed not to impude income. Now she wants to go back to the 2/3 - 1/3 agreement because she has run up her debts. We have been divorced 3 years. She can't get spousal maint. or add'l child support. We did not have anything in writing regarding this agreement but neither of us have maintained this account and I have receipts from her over the past 3 years that she has paid 50% of the sports costs. Can she go to court over this agreement when there is no account to maintain? The decree does not say anyhting about maintaining the account or anything, it leaves it open.

Re: decree issue

I believe you are correct, but I would have to see your decree and all of the "proof" you have in your possession to know how to advise you. We offer a free consultation if you are interested in getting together.
