Legal Question in Family Law in Minnesota

Divorce Decree/unable to comply

I was supposed to put my car in my name per the divorce decree but was unable to without a cosignor due to being self employed. I have now lost my job and debating bankruptcy. What can happen to me if I was unable to secure a loan on my own as she was the cosignor when we were married so I assume they will go after her to collect the debt? I tried, but the banks wouldn't let me. What can happen to me as I would assumeit is a violation of a court order?

Re: Divorce Decree/unable to comply

A person may be considered in contempt if they fail to follow a court order. However, a defense to contempt is an inability to comply.

However, if you default on the car loan and, as a result, the creditor seeks payment from your ex spouse, your ex spouse may seek a remedy in court and payments from you depending on the protective language that was included in the divorce decree.
