Legal Question in Family Law in Minnesota
My divorce was finalized Sept 2013. My ex is not paying child support or following almost all of the stipulations in the divorce decree. I cannot seem to get concrete information about the 6 month de novo review. Not even from my own attorney. She makes it sound like I shouldn't do it. Isn't the review an opportunity for the judge to see that he is not complying and make changes or give consequences?

Since you felt the need to post of this issue on a legal informational website, I point out to you that you may obtain a second legal opinion and you may change attorneys at this time. With six months nearing, I urge to act with no delay should you seek outside counsel. Attorneys provide personal service to the client. The client should feel a sense of great trust and confidence in her/his attorney. A six-month review hearing can be scheduled to make sure parents are following court orders for custody, parenting time and child support.
It is important to note, however, that a court cannot change orders at this hearing, but it can take steps to make sure the orders are being followed.
You should be sure to consult with an experienced attorney.
