Legal Question in Family Law in Minnesota

Divorce rights in case of infidelity

My wife of 24 years and I are going for a divorce. Since there were no children, we have agreed to an amicable collaborative agreement to end the marriage. She now is carrying on a hot, torrid homosexual romance with her niece. Should I escalate it to a court case and sue for alienation of affection or ''let sleeping dogs lie.''

Re: Divorce rights in case of infidelity

There is no cognizable right of action for alienation of affection. As a result, that is not an option.

However, if you cannot reach an agreement, you would be required to file the divorce in court and, perhaps, litigate the issues.
