Legal Question in Family Law in Minnesota

divorced?

i have been separated from my husband for several years, but was recently told that he had gotten remarried. My question is this: how can i find out if he got a divorce from me before getting remarried?

Re: divorced?

Check with the court clerk in the county where you and your husband lived to see if he filed a divorce and the status of the case.

Re: divorced?

Were you ever served with a summons and petition for a divorce, in any jurisdiction? More to the point, even if you were once served, did you aever receive a divorce decree -- something that in most jurisdictions would be captioned, "Judgment and Decree," or maybe just "Judgment?" If you have not received either of these things, you may still be married.

You could, of course, simply ask your ex-husband to produce a copy of your divorce decree, or at least tell you where the case was filed.

If that is not possible, you can check to see whether a file was opened on which you were a named party, whether in your jurisdiction, or in other jurisidctions where your husband has lived (that is, in the counties where he has lived). If a decree has not been filed anywhere, you are probably still married.
