Legal Question in Family Law in Minnesota

ex-wife sending new husband to pick up kids

My ex-wife and I have a court ordered parenting time agreement which clearly states that ''the parent'' will pick up our children (ages 5 & 7). She is trying to send her current husband and I am not comfortable with this. Can I keep the children back until SHE comes to get them?

Re: ex-wife sending new husband to pick up kids

Frankly, I do not believe a Judge would share your concerns regarding a new spouse. I think you run a significant risk of angering the court by witholding the children without a good basis to do so.

First, he is her husband and, as such, has a significant, but different relationship wioth the children.

Second, if he is not a danger when the children are with him in the house during the parenting time, he is not a danger to drive them. You do not indicate that you have any specific concerns other than parcing the language of the decree. Without more, you lack of comfort with the arrangement is not a good argument.

Choose your battles wisely. This is not a wise battle.
