Legal Question in Family Law in Minnesota

Ex-wife's business bankruptcy

My ex-wife had a business in her name.

Unfortunatly I co-signed on the lease

for her business space. Her business

went bankrupt and she now is being

taken to court for late lease payments

and the remaining lease payments. In

the divorce she was awarded her

business which I did not have my name

on at all. So now since my name was on

the lease is there a way I can get out of

this situation.

Re: Ex-wife's business bankruptcy

You are in a difficult spot. As part of the divorce, you should have had your name removed from the lease by having her sign a new lease. Since you did not, you have limited options.

The creditor is not bound by your decree. As a result, they may rely on the lease contract and pursue you for payment. You r only option is to, in turn, sue your ex for any payments you would be required to make.
